Legal Question in Employment Law in Colorado

Wrongful Termination

I was recently dismissed from my job after 12 years with the company. I had expressed displeasure at the work load to employee ratio (all employees in the department had also done this.)After no action was taken (as promised) I again protested and expressed a desire to resign if we could not reach some sort of arrangement. I never said that '' I resign'' but I was released from employment and was told I had resigned and it was accepted. I never signed any type of termination paperwork or a letter of resignation. After mutually meeting with HR by boss said he did not think that my working there was a good match and that due to some physical / stress related problems i had recently experienced it would be best for me not to work there anymore and I was terminated I know I cannot be fired for medical reasons. What is my recourse? I cannot find a job now because my job field is doing very poorly.

Re: Wrongful Termination

From what you have written, it is difficult to know. Did you have an employment contract? Is there an employee handbook regarding termination- how and why? Is there any other reason for termination? You can contact the Colorado Civil Rights Commission, but this does not really sound like that.

If you do not have an employment contract and there are no provisions on how someone is to be terminated in the employment agreement/handbook, then you are likely an at-will employee and probably have little if any recourse.

Could this be age discrimination or something similar?
