Legal Question in Landlord & Tenant Law in Colorado

breaking apartment lease

I signed an apartment lease to begin in 3 weeks, I have not moved in and do not move in for 3 weeks. My job told me I will be transferred out of state within 2 months. Can I break the lease or re-negotiate lease before I move in?

Re: breaking apartment lease

Morning,

There is no statutory or common law right to break a lease without consequences because of relocation. Once you signed you are liable. If you break the lease they can sue for breach.

Contact them ASAP and try to negotiate something. The landlord has a duty to mitigate damages (relet) and the sooner they can advertise and try to rent the less likelihood of damages.

Get calling.
