Deposit on rental property

I put down a deposit on a possible restaurant space for lease.After some reserch on the property I found out the space was not to code.The landlord did not want to pay to bring it to code,so I backed out of deal and did not sign the lease.The space was advertised as the ''finest resturant space in town''Am I entitled to my deposit back?

The issue might be framed as follows: What kind of an oral agreement or understanding did you have with this prospective landlord regarding this deposit which you tendered in a good faith manifestation of your intent to lease this

commercial space?

If you're not exactly certain as to what the terms were governing your deposit, one sure way to find out what the landlord understood them to be (as far as he's willing to let on)is to firmly request the return of your deposit.
