If my landlord moved me into my apartment with a safety related item lacking am I entitled to break my lease with no fee and get the rent I had previously paid returned to me in full?

The answer to the second part of the question is certainly no. There is no provision in Colorado law that will allow you to claim a refund for rent for a period where you actually lived in the property.

It is possible for you to break the lease without owing further rent or fees if you follow the requirements of the Warranty of Habitability statute and the landlord does not correct the issue in the appropriate time. You need to review that statute or retain an attorney to assist you.
