We have renters not paying and we want them out but they will not leave and the law will not help us. The lease has run out. My question is, when and how can we assume the property is abandoned due to the fact they will not answer the door or receive phone calls?

Hello,

You can't assume the property is abandoned just by them not answering the door or receiving calls. Moreover, your facts are contradictory to this claimed abandonment. You say they will not leave. If they will not leave, then they have not abandoned the property. You can only get them out through an eviction.

Contact an attorney because the steps are rather specific and if you fail to follow appropriate procedures, you are open to a lawsuit for damages. Do not just go in and try to kick them out, change their locks and other self-help measures. Unless it is perfectly clear that you have that right in the lease (and even then it is not advisable), you are violating the law, you will be sued and will lose that suit. Get an attorney, honestly.
