Legal Question in Personal Injury in Colorado

Injury Settlement after Automobile Accident

My daughter was injured in an automobile accident. The other drivers insurance company is going to offer her a pain & suffering settlement. I would like to know if the amount they are offering is reasonable. The accident occurred 5/15/1999. She was 18 at the time of the accident. She has a compression fracture of the L1 vertebrae. She was hospitalized for 7 days, in a body brace for 3 months. She has been in physical therapy twice, and still experiences some discomfort. The primary physican has said that her condition is permanent. She has resumed most of her normal activities. The other driver has a $100,000 policy limit. The other drivers insurance company has said they are going to offer $25-$30k in a settlement. Is this a reasonable offer for this type of injury? Thank You.

Re: Injury Settlement after Automobile Accident

I have never known an insurance company to say they are "going to make an offer." They either make an offer or they don't. You may wish to check your facts.

Without knowing whether or not her attending physician has ascribed a per cent of whole body impairment to your daughter's injury your questions cannot be intellgently answered. Also, knowing the total amount of the medical expenses directly associated with this event is important. Are there lost wages, property damage and other items involved also?

It will take greater information to answer you questions.
