Legal Question in Personal Injury in Colorado
is the insurance company correct?
My 10 yr old daughter and I were involved in a vehicle accident in Colorado on 5/07 (through no fault of my own, a young man ran into our vehicle with his). She recieved an injury to the face that required stiches. It doesn't seem that it will affect her health in a negative way as she grows. I am looking to settle and the insurance company told me that any claim over $10,000 will have to go to court due to it involving my child who was a minor at the time of the accident. Is this an accurate statement?

Re: is the insurance company correct?
There is no law that says that. It may be the insurance company policy to take all claims over a certain amount to court. Insurance companies will lie to you.
I suggest you get a good personal injury attorney. A cut to a child's face could result in a scar or nerve damage that will not show up for a while. I am sure that you would want the best treatment and settlement for your daughter if she is harmed in this way.
Money is the way to get there. Money can by the treatment to make sure this is minor and temporary.
I do not want you to find out you made a mistake in a couple years.
