Vehicular Homicide is found at CRS 18-3-106 and can be either a class 4 or class 3 felony. It reckless driving is the reason for the accident, then class 4 carrying 2-6 presumptive with aggravation up to 12 years. If alcohol or drugs were the reason for the accident, then it is a class 3 felony carrying 4-12 presumptive with aggravation up to 24 years. Both are probation eligible.
