Legal Question in Personal Injury in Colorado

Nightclub security assault?

I was recently at a Denver nightclub. I was intoxicated, had no run ins with club patrons or workers while inside. I know when to say when and when it's time to go home. I was outside the club with a friend on the sidewalk trying to get a cab, not talking to anyone other than my friend. club bouncers asked me to move b/c a burrito vendor wanted to set up shop where i was standing. my friend and i responded that ''it's a public sidewalk, we're trying to get a cab home, we're not bothering anyone.'' asked us to move again, saying we were interfering with the burrito lady who was trying to set up on the sidewalk. i refused saying i'm getting a cab and going home, my friend and i were taken to the ground and put in a choke hold. we did not initiate physical violence nor did we try to strike the bouncers back. the police were called, i was cufffed. police didn't ask me ANY thing. i asked specifically if i was being arrested, ''yes, get in the car'' i asked what the charges were. no response, no rights read. i was taken to detox, i wasn't ''arrested, i wasn't charged'' but i still have to pay $275. should i drop this and let it be and feel lucky that nothing is going on my record? or should i file a complaint against the club bouncers?

Re: Nightclub security assault?

If you have accurately and completely related this event, you or your attorney should not only file civil assault and battery charges against the bouncers personally and the night club, but also you should demand that criminal charges be filed against the bouncers.

It is possible the burrito vendor has a license to set up on the sidewalk where you were standing, and it is possible that you were required to move to allow her to set up. But it is not possible that the bouncers had any right to use physical force on you or your friend.

Good luck.
