Legal Question in Personal Injury in Colorado
in the state of colorado, is it against the law for an auto insurance person to contact a hospital about whether a persons bill is paid and how it was paid? or to tell them there is going to settlement money when the victim of the accident has not given any authorization verbally or written, to contact the medical provider? the accident was not my fault, I am the victim. the insurance co. is the person at faults.

In Colorado, a hospital can formally file a "statutory lien" against any third party liability insurance carrier. Assuming that the hospital properly and fully complies with the statutory requirements to make its lien enforceable, then the third party liability insurance carrier (such as State Farm Auto Insurance Company or Farmers Insurance Company) would have an obligation to make sure that it does not pay you (the victim) without also resolving the hospital's perfected statutory lien. There are a lot of legal issues involved in these situations, Please call me at 303.861.1042 or email me at [email protected] if you want to discuss the matter further.
