Legal Question in Real Estate Law in Colorado

Three brothers are on the deed to their Father's home and he passed away. A few years ago one brother paid the Father's house off to help out the Father. Now the house is being sold and he wants repaid. This was never told to the Father or the other two brothers that this was what the 3rd brother wanted. Nothing is in writing that he was owed the money back by his Father or any knowledge of repaying it to the brothers. Can he claim this at the time of closing as a debt owed by the Father?

Unless there is a document in writing, the answer is no. It will probably be treated as a gift to the father.
