Legal Question in Real Estate Law in Colorado
My buyer purchased a 40 acre +/- farming property based on legal description. The survey was done post closing. The parcel ended up being 34.5 acres and county has denied his well petition since it is under 35 acres.
What is the reasonable standard deviation for +/- in this case? Can you sell 40 acres only to give the buyer 34.5?

What does the buyer want to do? I don’t know the answer to your questions but I do know you’ve got to work something out with the buyer or else you’ll both be spending many thousands of dollars in legal fees.
