Legal Question in Real Estate Law in Colorado

corporation

A friend wants me to put my land in the name of a corporation which I will be owner of and he will be President or manager. Will I be able to get my land out of the corporation at anytime or will he have control over it? Is this a good idea?

Re: corporation

I can't emphasize this advice enough: speak with an attorney and possibly an accountant. First off, holding real property in a corporation is normally a very bad idea on a tax basis. Second, as to having an entity with this manager, you must--repeat must--talk to an attorney to draft a written agreement that is appropriate and avoids a contentious relationship that will end up in court. The agreement should provide who pays what, what happens if you come to a disagreement and the like.

Again, do not even think about doing this without legal advice. I have seen problems based on these bad ideas all too often.
