Legal Question in Real Estate Law in Colorado

Job Transfer while in a lease?

Just trying to figure out if there is a Colorado Law if my job transfers me while I am under a lease? I cannot control my job transferring me and if I provide a letter showing they are transferring me it should cancel the lease. Or am I wrong? I was given that info by my employeer. But my leasing company is saying otherwise. Which is correct?

Re: Job Transfer while in a lease?

Hi,

A quick answer: No there is no Colorado law that allows you to unilaterally terminate a lease because of a job transfer.

Review the lease to see the terms regarding cancellation, assignment and subletting. I doubt there is anything in there allowing you to cancel based on transfer.

You should contact your landlord and try to make arrangements. I would immediately start posting and trying to sublet or assign the apartment, if allowed.

The landlord can sue you for breach of contract. They must, however, mitigate damages, which means that they must try to lease the apartment. Again, review the lease and start looking to sublet or assign. Good luck.
