Joint Mortgage

3 years ago I purchased a home with an ex boyfriend (big mistake). I have since left him. I filed the quit claim deed, but I understand that the only way to get my name off of the mortgage itself is for him to refinance or sell the house. It has been 2 years and he still has not refinanced and is not being very cooperative. Is there any legal action I can take to FORCE him to refinance or sell the house?

You need to talk to an attorney. Are you saying you just quit claimed your interest in the deed to him without being removed from liability for the debt? So are you still paying for the mortgage?

Regardless, absent some mutual agreement, if you cannot resolve the issue you may have to file a partition action. Contact an attorney before you take further actions that may harm your rights and options.
