Legal Question in Real Estate Law in Colorado

Joint Owners

In a divorce decree, a jointly owned mobile home was to be sold and proceeds divided equally. This divorce was granted over 5 years ago and the home has not been sold. My former spouse has lived elsewhere and I live in the home and have done so since the divorce. I have maintained the home and have paid the yearly taxes. I would now like to dispose of the home for what little value it has and am in a quandry. Is there some protection under abandonment for me so I do not have to divide the proceeds of sale? Is there any protection for me at all? A title to the mobile home was issued in both names which my former spouse has possession.

Re: Joint Owners

This is probably more of a divorce question. But, you should collect reciepts and document all money you have spent on the place since the divorce. This money may offset what you would owe her. But, she may ask for reasonable rent from this place or her half since you have been living there.

Truly, you should consult a family law attorney.
