Judgmental amount for late fees on rents due?

We have a court date on September 19th to prove our case against our renters on the amount owed because of their excessive late payments of their rents. They signed a lease stating a $25.00 late fee, but many attorneys have said that is excessive. What amount is fair??? Is their any liability to the tenants, from the judges view, as to their agreement to pay rents before the 5th day of each month???? They also signed a promisory note stating all late fees would be paid, or deducted from deposit upon vacating of rental. Any advice for defendents would be helpful. We have all documentation and proof. HELP!!!!

I probably got this too late but would be interested as a matter of curiosity what the judge ruled. What's fair is generally what is reasonable considering the amount of the rent. It sounds to me you taken a lot of reasonable steps to protect yourself.
