Legal Question in Real Estate Law in Colorado
Lack of neighbor's landscaping is drowning my plants.
The subdivision I live in has strict rules on landscaping. All the people living in the subdivision is required to landscape within 3 months of move in (the subdivision is brand new). I lived in the house for 8 month and my next door neighbor was already living in the house when I moved in. I hired a landscaper and finished the job several month ago. As of today, my neighbor has done the landscaping and due to this all the water is coming to my backyard and drowning my plants. The Architectural Review Board is forcing my neighbor to landscape and I'm not sure whether he is complying. I would like to make my neighbor pay for the damages but I'm not sure whether I have a case. Can someone help me answer?

If your neighbor is not in compliance with the rules or declarations or covenants in your neighborhood, you could probably sue him or her and collect damages for his or her failure to comply.
You have not stated the amount of damages that you have, but if it is a few thousand dollars you can go to small claims court.
