I signed a lease (1 bdr / $800 per mo.) for an apartment in downtown Denver for 2-1-01 to 2-1-02. The lease specifies $40 is due in addition to the rent to cover heat, gas and water. When I moved in in February the heat was not functioning properly and I made written complaints. I was told that it could not be repaired until the summer. So on the coldest night last year, I was offered a hotel reimbursement of $75 for the weekend (no where near the actual cost. In October, along with other tenants, I complained (by certified mail) and was told it that the heat works. It is set on a timer that kicks on for 45 - 60 minutes twice daily, certainly not long enough to heat my 700 square foot loft. I have taken the temperature on several occasions at below 55 degrees. I have been given space heaters (ones without safety features) which run on a lot of electricity (not included in the utilities that the landlord pays) and have been told to turn my gas stove on high. I am 2 months pregnant. I am very cold, very stressed and have symptoms of a cold. I cannot afford a hotel or to look for a new apartment and the landlord refuses to relocate me. What are my rights?
