Lease termination and Landlords

My soon to be ex-husband and I own a rental house together. I want to give the renters thier 60 day written notice in order for me to occupy the propoerty, he does not. Does he have to sign the notice to ternimate the lease or would my signature be enough? We have both signed the lease agreement.

You need to contact an attorney to review the lease and consider issues. If these renters have a lease, that controls and you cannot just try to move back in absent that right or other circumstances.

As to the parties, if it was signed by both of you, depending on the terms, an amendment or attempted notice to quit may need to be signed by both.

So absent review of this lease and other facts, it would not be prudent of you to do anything. Get advice or you may just cause further issues and possible litigation.
