Liens on Private Residence
I hired a highly recommend 'handyman' to do some remodeling on a home at an agreed upon amount per-hr. Each day,, I wrote the time on the calendar as I did with the time he left. We have a big disagreement on hours and has threatend to lien the property. He did electrical work ( not licensed) and 'by mistake' did $3500.00 damage to various electronics on the premise. (I have repair and replacement reciepts). We had traded him about $1000.00 in personal items from our storage shed which was to be counted in his hours. He denies this and told me we just 'gave' him the items. He admits doing damage. I have paid (in cash) more than the hours that I have logged and with the trade and damage he owes me a great deal of money.He also did plumbing work...a great deal of it...without a license. Much of the work is not to 'code' although I gave him the various books, left notes and told him verbally he was doing wrong. He continued telling me I did not know what I was talking about. Is he able to file a lien on the property for what he says we owe him? Should we be the 1st and file a lawsuit?How can I file a lien on his property for what he owes us? I have some questions. Was anything in writing? Did he pull permits? How much do you owe him? Based on what you asked, he can certainly file a lien but your defenses should defeat his claims. The problem is that whenever things are not in writing problems are more likely. Call if you wish to discuss.
