Legal Question in Real Estate Law in Colorado

Mechanic's Lien

Is a general contractor able to request a lien prior to the completion of the project. Example-the initial phase (of three) is almost completed but the homeowner is not complying with the contract. May proceedings begin now?

Re: Mechanic's Lien

If the contract is clear and they have not paid as provided in the contract terms, you may be able to send an intent to lien and file the lien for the amount of work done and due at that time.

Please be advised that lien law is strictly construed and failing to comply with all requirements may terminate your lien rights. Contact a construction attorney.
