Legal Question in Real Estate Law in Colorado

Neighbors going to sue

Recently we got 4.5 inches of rain within 2 hours. We have a buried drain pipe for our gutters on the side of our house, which under normal conditions work fine. We are on a slight hill above our neighbors. When one of the buried drain pipes overflowed, the water ran downhill, into the neighbors basement window. The glass broke and flooded two of their basement rooms. We considered them friends, and told them we wanted to what we could to help them out, and did help them clean the rooms, etc. We were ready to go to mediation to find an agreement to help them financially too, but before we had a chance to talk to them about it, we were told they filed a liability claim to our insurance company. (Their own homeowners insurance also refused to pay.) We were told last night the claim was denied, and that we werent liable. Now they intend to sue. Our insurance company said they would represent us in court. My question is- is it advisable to get a second attorney? What other things should we be doing to deal with this mess? We no longer are very interested in going to mediation, due to the neighbors lying to the insurance company, and going the hostile route.

Re: Neighbors going to sue

Morning,

There is no particular use of getting a second attorney unless you do not trust your insurer to get appropriate counsel or you want another opinion of their decisions.

Good luck.
