Legal Question in Real Estate Law in Colorado

real estate lien

I pd a contractor to black top part of my car lot. He did not pay for the black top so the supplier put a lien against my property. Does the supplier have to refile the lien every so many months to keep it legal. I have tried in vain to recover from the contractor, or am I just SOL and will have to pay again. --name removed--

Re: real estate lien

Sorry about the problems. You should first be sure that the lien filing was totally accurate as to amount, timing, service and so on. The lien statutes are strictly construed and one mistake can void the lien. It is impossible to know without review of the lien filing and notice and more information.

Depending on the amount due, you should consider suit against the contractor as you have some options to increase the damage amount and otherwise apply leverage to get this paid. Email if you have questions.
