Is the seller responsible for fixing problems within the first year of purchase in the state of colorado? We purchased a house last September and the basement has flooded, we have pulled back the carpet and found that cement has been pured over the previous floor. This is the second time "ground water" has flooded the basement.

No, there is no one year home warranty law. Your rights are embodied in your contract and under possible claims on failure to disclose. If there is no warranty as part of the contract, then you should next review the required disclosures by the seller. Did they disclose about flooding in that area?

You should contact an attorney to discuss this matter and negotiate a resolution, on the assumption that this is a failure to disclose. Good luck.
