Legal Question in Real Estate Law in Colorado

Settling a Lawsuit for Non-disclosure and misrepresentation

If we take legal action against the seller of the home we bought, two real estate agents and a structural engineer (just a home inspector represented as an engineer) and projected legal costs appear they will be greater than the cost of repairs, etc, does something called ''nuisance value'' come into play where the defendants would likely pay us a few thousand dollars (vs. the $75,000 claim) as part of our agreement to condider the case as settled?

Maybe, maybe not. It is a bad idea to proceed with a claim based on some perceived nuisance value. Either the claim has legal merit or it does not.

Rather than guess, contact a real estate attorney.
