Legal Question in Real Estate Law in Colorado

Tenancy and Eviction

I live on ''family'' property. Property that was my dads when he died, my mom got it when he died, promised it to us (his kids) and let me put my home there (manufactured home). Now, my mother is wanting to evict me because I am engaged to someone out of my race. What can I do? Does anyone know of Colorado attorneys who can help? I was told by my attorney that a discrimination case based on race would be VERY COSTLY. Any advice would be helpful.

Thanks

Re: Tenancy and Eviction

Morning,

I have no idea what that attorney was thinking but this has nothing to do with discrimination. It, at best, is a matter of breach of contract, promissory estoppel or equitable estoppel. The last two are essentially claims that even without a binding contract (which I doubt you have here) that the person is "estopped" from invalidating an agreement if you acted in reasonable reliance on that agreement and incurred costs. It is considerably more complex than I described, but that is a thumbnail sketch and may or may not apply to your situation.

If you cannot come to an agreement you will have to sue her over this issue, but it will be difficult and costly. You will need an attorney or expect to spend dozens and dozens of hours trying to understand the case law and issues. There are loads of issues.

I would advise coming to some agreement and get that in writing (with advice of counsel). If that is impossible, contact an attorney and consider the options.
