Legal Question in Real Estate Law in Colorado

What is the time limit for filing small claims court claim or case

I have a dispute with a former landlord regarding the return of my deposit. She withheld over $350.00 from $675.00 for ''late payments'', which I was never aware of because: 1) She didn't inform me the mail was ''late''; 2) She didn't cash or deposit my rent checks on a timely basis. At times 2 weeks would pass before it would clear by credit union. 3) The supposed late charges started after my new husband moved in. It almost seems as though she was trying to collect more rent for 2 people instead of 1.

Based on this information, you may have up to a year to file a claim in Colorado.

You will need to show the rent was not late in order to win.
