Legal Question in Traffic Law in Colorado
Driving without lisence NEED HELP!!!
I just got pulled over the other night(2am) and the northglen officer gave me a ticket for DUR. I have got 4 other DUR's in the past went to jail, paid a lot of fines and so forth. I know i will lose my lisence for 4 more years. But what i am afraid of is becoming a habitual offender. Which means i will never get my lisence bag again. What are my options?? Can i have my brother take the fall or a freind?? I they say they were driving and forgot their lisence and let them put my name down?? I did not sho him my id, jsut gave him insurance and regestration. PLEASE HELP ME!!!

Re: Driving without lisence NEED HELP!!!
Hello,
I would recommend that you do not try and have your brother or friend take a fall, here's why: If they do go to the police and say that they were the driver and that they gave false information at the time of the ticket, then they would most likely be charged with criminal impersonation, a class 6 felony, which could likely result in more severe penalties than you are looking at. Felonies can result in doing time in state prison. In addition, the attempt would most likely fail anyway because you signed the ticket and the police will compare the signature on the ticket with another sample of your signature (possible the signature on record at the driver's license department), and then you would likely be charged with an additional crime of false information to a police officer, attempted obstruction of justice, etc.
Some traffic tickets do not require the involvement of an attorney, but in your case I believe you are going to need one. You do potentially face the possibility of habitual offender status. If you call me on Monday, we can talk more about the details and your options. You need an attorney that will look at the issues involved in the grounds for the stop, etc. I would not recommend making any statements or taking any actions until you discuss this with an attorney.
