Legal Question in Traffic Law in Colorado
Hear Say Basis For Traffic Ticket
My son received a ''Disobey Stop
Sign'' (ran a stop sign) ticket from an
officer based on a phone call the
officer received from a homeowner
near the infraction location. No
''Complanant'' is noted on the
citation. Can an officer really write a
ticket to a driver 5~10 minutes after
the alleged infraction based on a
telephone call? I thought infractions
must be witnessed by an officer or
his proxy?

Re: Hear Say Basis For Traffic Ticket
A police officer can issue a citation for conduct that was not witnessed by the police officer. However, the officer will not be a very good witness in support of the citation, because the officer did not actually witness the incident. It may be a good idea for your son to dispute the citation, because the actual witness of the incident may not show at the traffic hearing.
