Legal Question in Traffic Law in Colorado
hit and run
I was driving home late and crashed my car into a pole. I had been drinking so I got out and ran. I called someone and had them pick me up about a mile from the scene. They took me home and I went to bed. The police showed up about 3 hours later at my house. They asked me where my car I was. I played dumn and said it was in the garage. They said no that it had been wrecked. I acted like it had been stolen and that I left the garage open with the keys in it. They ended up leaving and not arresting me, but said my car was in the impound. Now it is being held in the impound by the Hit and Run division. They said it is being held there until they find out who was driving. Are they going to charge me? Do I legally have acess to my personal belongings in the car? What can they do and what should I do?

Re: hit and run
Well, I cannot tell you to commit a crime, so I will not. But, you have absolute right not to talk about this case without an attorney present and I would exercize that right. They may keep your car long enough to test it in what ever ways they can, but they cannot keep it forever. I would go to impound and ask to get the car. If they say no, ask when it will be available and why so long. Ask if you can get personal property out of the car. Do not talk about the facts of this case - blame it on the attorney you are dealing with.
