Legal Question in Traffic Law in Colorado
Photo Radar - Summons Issued Has Incorrect Information
My son received a photo radar ticket in the mail. The picture does show him driving but the ticket contains incorrect information. It lists the cars plate number and lists my son as the registered owner of the car. This is incorrect. The vehical is owned by and registered to his sister. How could this ticket be issued directly to him? How would the police be able to relate him to this car when his name doesn't appear anywhere on any records relating to this vehical. Don't they have to issue the ticket to the owner of the vehical based on the license plate information? This could have been my daughters boy friend driving for all they know....
With this one item on the ticket being incorrect, what's the chance of getting this ticket thrown out for the incorrect reference to him owning the car?
Thank You.

Re: Photo Radar - Summons Issued Has Incorrect Information
Hello:
This may be a great mystery that never gets answered regarding why the ticket has your son as the registered owner instead of his sister. Is it possible the ticket was first issued to the sister and that she then provided the correct name of the driver?
I don't think your son will be able to get out of it now that it is in the correct name. If you have any other questions, please feel free to call me. David Colt
