Legal Question in Traffic Law in Colorado

Speeding Tickets

My son,16,was issued a speeding ticket by an officer for going 85mph in a 50mph zone. There was no radar gun involved. The officer estimated my sons speed by how fast he had to go to try to catch him.My son had went through a curve and turned down a dirt road, off the main road, and had stopped (for other reasons,) when the officer caught up with him.The officer never turned on his lites until he pulled up behind my son who was out of the car and in the trunk. Now I have no dought my son was speeding and maybe even 85 but is it possilbe to get it thrown out because of no radar gun involved and it was just a guess on his speed?

Re: Speeding Tickets

You present several issues that may work. Either way, the DA may reduce the ticket substantially based on the evidence - if you know what to say. The evidence that the cop has is his expert knowledge as to how fast someone is going and all that, but likely that is not proof beyond a reasonable doubt. A judge may or may not throw that out, a jury would likely reduce it at least. Is there proof that your son was driving? How does the officer know that someone else was not driving - after all he got to the car after it stopped etc. You have more issues than most.
