Legal Question in Traffic Law in Colorado
ticket for rolling through a stop sign
I would like to fight my ticket for rolling through a stop sign. The
officer pulled out behind me about a block or so before the sign
and I couldn't tell it was a police car because it was dark. I did not
come to a complete stop at the sign, but the officer didn't turn his
lights on at the time of the infraction. He followed me to my house,
where I parked and he parked behind me. I was about to get out
when he finally turned on his lights. I really don't think he intended
to pull me over, he just did it because it was convenient since I had
already parked. In my county the ticket is $100 and 4 points.
What is the chance of getting out of it or getting it reduced, and is
the above a good defence?

Whether the ticket will stand in court or not depends solely on whether there is evidence that you committed the violation (in your case, whether the officer actually saw the rolling through of the stop sign). If the officer testifies to seeing the violation, you will most likely not win the case. The Court will probably not be sympathetic nor concerned with what actions the officer took between the time that he observed the violation and the time that he wrote the ticket.
Here is what I would recommend: Talk to the prosecutor and see if he will offer you a reduced charge. Don't get into the details of what the officer did before he pulled you over, just see if he will offer you any type of deal... quite often this happens.
