cashing certificate of deposit

My mother passed away 3 weeks ago and I have come across a Certificate of Deposit in her name only. There is no Power of Attorney and no will that I can find. How can I possibly cash this CD?

Depending on if the estate is worth $50,000 or less and whether or not there is real property involved you may have to open probate. The other option is using a small estates affidavit to get the money if possible. Call me or e-mail me and I will walk you through either scenario.

The estate and the CD may qualify for use of the Small Estate's Affidavit.

This is used by the proper successor in interest to your Mother. Whether you are that person should be discussed with a qualified estate attorney in your area.
