Legal Question in Wills and Trusts in Colorado

challenge will

My elderly friend's father cut him out

of the family will for not contacting

him for 40 years, but my friend was

unable to, due to mental fears and

lingering childhood programming of

negative nature. He tried, but was

too frightened.

Therefore his 72 year old sister, the PR grabbed his ''would be'' share and the momentoes and left

to WA state. She got a Restraining

order to stop him from begging her

for a small share of the estate(he

needs the money, being on SSI)

....Is there any way to recover

any of these estate funds?

Re: challenge will

Your friend should contact an attorney who is experienced with Will challenges. If the Testator wrote the Will under a mistaken assumption, or under undue influence from the friend's sister, there could be issues.

Will challenges are normally difficult cases to win where the claimant is challenging just because they are unsatisfied over their share.

However, your friend would be advised to seek the advice of an expert estate attorney to assess his rights and options.
