Legal Question in Wills and Trusts in Colorado

constesting a trust arrangement

In general, how secure are trusts at guaranteeing that the deceased's wishes are followed (i.e. are they easily contestable in court?). My family has some concerns over a stepmother's threats to challenge trusts which my father has established to take care of her and his biological children. Her share amounts to 50% of community property and income from assets he acquired prior to meeting/marrying her. She wants the principal from assets he wants to protect for his bio children, including his interest in their primary residence, which is to pass onto his bio children upon her death.

Re: constesting a trust arrangement

A trust, like a will, can be contested for a number of reasons. Without knowing the entire situation, it is not possible to answer your question with any confidence. I would recommend that you meet with an Elder Law attorney to go over the situation in detail and advise you of your options.
