Legal Question in Wills and Trusts in Colorado
Deeding real property into a living trust.
We would like to change the way we hold Title of our real estate and then deed the real estate into a living trust. Could you please explain the process to me and let me know what forms I would need to do this?

Re: Deeding real property into a living trust.
The process will depend on how you presently own title to the property.
The best approach is to work with your attorney to ensure that you will follow the proper procedures in transferring title to the revocable trust.
Generally, the owner of the property will use the same type of deed that they received when they acquired the property to transfer to the owner's revocable trust.
This can be more complicated if you have a joint trust, or the form of title is not solely in the name of the settlor of the trust.
Because of these potential complications, you should work with the attorney that helped you create the trust, or with an attorney experienced in such matters. You should not attempt to accomplish this on your own without the advice and assistance of counsel.
