Legal Question in Wills and Trusts in Colorado
Disbursement of Inheritance to a Minor
I am trying to find out how to get my minor children's inheritance sent to them. We live in Colorado and the disbursement is being made in New Jersey. The will states: "To my great-grandchildren, ..., I give and bequeath to each EIGHT PERCENT (8%) of my Estate...In the event any beneficiary shall at the time of distribution, be a minor then I appoint as Guardian of the property of such minor, his or her parents." The distribution lawyer is telling me that I need to set up accounts through the court system for my children. Is this true? How do I prove that I am my children's parents?

Re: Disbursement of Inheritance to a Minor
You should be able to establish custodial accounts here in Colorado and have the distributions made to those accounts. A Colorado Court would accept that procedure. You should check with the attorney handling the estate to determine whether further action will be required.
