Legal Question in Wills and Trusts in Colorado

Who gets estate without written will?

I was wondering what happens to someone's house and land if they die without a will. (Specifically for Colorado, but I'm not particular - it's for a story).

1)Do family members have a claim to it?

2)Do long time friends have a claim to it?

3)How would a judge decide?

4)What if the deceased were murdered?

Re: Who gets estate without written will?

In Colorado the answer is quite simple and no judge would be involved except in unusual cases. There is a Colorado statute that decrees who in the family of the deceased would receive the property if the deceased did not have a Will.

The property would pass via Colorado's system of heirship. You can contact me if you have further questions.
