Excecutor of Estate Misconduct
My husband's best friend died of terminal cancer 3 years ago. He told us a week before his death that he had made a new will and that my husband was to receive part of his estate. After 3 years we still have not heard anything from the executor of the estate, his brother. We suspect that the brother is using up the money in the estate for his fees. Doesn't the executor have to notify those listed in a will? What should we do to find out why the estate settlement is being delayed. I called the local probate court and they told me there is a case number and it is still open.

You must either visit the Probate Court Clerk in the county where the case was filed, or call the court and send a check to the Clerk to cover the cost of copying and mailing the file to you.
If upon receipt of the file you determine that the will did not leave your husband money, then there is probably no need for an attorney. However, if the will left money or property to your husband, or if there is some other indication of wrongdoing, I recommend that you have an attorney review the file and the will (which should be in the file) to determine how to proceed.
