Legal Question in Wills and Trusts in Colorado
Should the executor of my will be made beneficiary of my various assets to accomodate my wishes for division of the property?
1 Answer from Attorneys
In Colorado, we use the term personal representative and not executor. As a general matter, the personal representative has the power and authority to carry out written instructions in the will and is responsible to the beneficiaries of the will under various fiduciary duties. A good overview of duties and rights is available here http://www.cobar.org/index.cfm/ID/20882. I recommend you review this closely.
As to your question, no a personal representative does not need to be a beneficiary and there is no reason to do this unless you want them to be a beneficiary of your estate.
I strongly recommend that you contact an attorney to advise you on your estate planning. This is not something to do by yourself if you do not understand your rights and the alternatives.
I hope the information was useful and I wish you the best.
