Legal Question in Wills and Trusts in Colorado

My father dies before my grandfather

My father died in 2001. His father, my grandfather, died in 2004 and his will left everything to my father (deceased) and my aunt (living). My aunt says that since my dad died first, that she is the sole benificiary of my grandfathers will even though my father is named in my grandfathers will as an heir to half of his estate. Are my mother or myself entitled to my father's share of my grandfathers assests?

Re: My father dies before my grandfather

The answer to your question depends upon the exact wording of your grandfather's will. Without seeing the document itself, it is impossible to tell for certain.
