House Deed

My boyfriends mother passed away with no will. Its just him and his sister. No one other that the mother is listed on the deed. What has to happen for him to take over the house? Will he have to go thru Probate Court?

Yes the house will be an asset in probate of the Mother's estate. Your boyfriend should hire an attorney experienced with estates to advise him about his rights, options and appropriate course of action.

He might even want to seek appointment by the Court as the Personal Representative of the Mother's estate.

If the mother was shown as sole owner on the deed, a probate proceeding will be necessary to change title to her heirs.
