Marital Prperty After Death
I have been married for 3 years to this man. He is now taking a job in Texas. My name is on nothing that he owns and he does not plan to put it on. I own nothing.I sold my house when we married and used for our new beginning. God forbid, something should happen to him, what happens to the house and allof his possesions? Do I become the owner, or am I out on the street?

The answer to your question depends whether your husband has a will. It may also depend on the total value of his estate; whether you have children together; whether he has children from a prior marriage; and whether he has transferred property to someone other than you during the past few years. You should meet with an Elder Law attorney to review the details of your situation and discuss your rights and options.

What happens to the property will depend on the terms of your husband's Will and the status of your family situation. Should he die without a Will, you have certain rights as the surviving spouse.
