Power of Attorney

My life partner had a massive stroke last Thursday, and unfortunately did not have a power of attorney in place for health care and/or financial. Her sister, who lives in Texas, wants to inact a power of attorney for her sister, my partner, putting me in charge of all of the health care and financial decisions. Is there a legal way to do that? If so, is there a specific type of power of attorney needed?

If your life partner is not incompetent to act, then no one can create for her a Power of Attorney.

Your option would be to seek guardianship or a conservatorship, although the same person cannot be both.

You should contact an experienced trust and estate attorney for advice before proceeding.
