Legal Question in Wills and Trusts in Colorado

We own property both here in Colorado and in Wisconsin. My husband also has a 1/7th ownership interest in his late mothers home which hasn't sold. Should we consider a trust rather than a straight will?

Yes. A revocable trust, properly funded, can assist in avoiding probate in the other states where your husband owns real estate interests. This is because real estate is a probate asset in the state where the property is located.

The trust can help avoid probate (or estate administration) in those states. Before proceeding, you should visit with an attorney specializing in estate planning and probate to learn how these issues apply in your particular situation.
