Legal Question in Wills and Trusts in Colorado

Regarding a Will that I was supposed to be in and was never informed of.

In 1995 my grandfather passed away and my uncle was exsecutor of his Will. My grandfather always told me that I was in his Will. When he passed away I never received anything from his estate. Is there a way of checking this out without asking my uncle as I am sure that he would not even tell me the truth, or do I need to do this through a Lawyer? Please let me know. Thank you in advance for your help with this question.

The probate file at the courthouse where the will was filed is public record and will contain all the information about the probate of the estate. You may read it or get copies for a fee.

Yes, there are ways of checking out the status of the Will. First, you can determine if your Grandfather's estate was ever opened. Also, the Will is required to be filed with the Court of the County he resided in at the time of his death. You would go to the District Court for that County and ask for the Probate Division. If he died in Denver County, you would just go to the Denver Probate Court.

This will enable you to read the Will (assuming that the Personal Representative followed correct procedures). If you were indeed named in the Will you should have received notice of all estate procedures for your Grandfather's estate.

If these steps are not successful, then you should engage an experienced estate lawyer to assist you further.
