Legal Question in Workers Comp in Colorado

Injured at work

What are the steps one should take after being injured on the job? How does one deal with workers comp, retirement agency and social security? When would I need an attourney and how would I select one.

Injured on job; what to do

First, notify your employer right away;

Second, get the proper medical attention.

Third, consult an attorney about your rights. Coordinating the various types of available benefits has made things very tricky, and because each program has its own purposes and requirements, what you do on one claim can help or hurt another claim.

Also, with tort reform, managed care, etc., all these programs are trying to be "secondary," i.e., to let the other guy pay first and deduct those payments from what they would owe.

So the sooner you get specific legal advice, the better. The good news is that it shouldn't cost you anything to consult an attorney since W/C cases are handled on contingent fee.

The above does not constitute legal opinion and is offered for the purposes of discussion only. The law differs in every jurisdiction, and you should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fully informed of all the pertinent facts and who is familiar with the applicable law.
