Bankruptcy Process
On Jan 11th, I paid a Lawyer $500 (1/2 of $1000) to file Chapter 7, which he said I am a excellent candidate for. He said in 2 days he would call for my wife and I to sign the papers. I call him once a week and he claims he is busy and instructed me to give his name and phone to any creditors that call me. It is now March 3rd, have signed no papers, I get no more calls, BUT, I still am getting bills from each credit card company, of course added late charges. Should I worry about his delay in the signing, or assume he is taking care of the creditors over the phone.
What is this 5 min. meeting he said we would have to attend after the papers are signed????

It appears that the lawyer that you have choosen is busy, perhaps you should try to talk with the paralegal to find out when you and your wife can come in and meet to sign the papers. You are obviously concerned and if you cannot get in touch with your lawyer, send him a note about your concerns. However, it is likely that he is talking with your creditors. Continue to give your creditors his name and they will call him.
The 5 minute meeting is the meeting with the Trustee under the provisions of Section 341 of the Bankruptcy Code. The trustee will be asking questions about your assets, liabilities, whether anyone has died leaving you any money in the past year and if someone dies within 6 months of the filing of the bankruptcy that money goes to creditors. The 5 minute meeting excludes waiting, but if you tell the truth you should be fine.
